Funiza Terms of Services

Please read these Terms of Use ("Terms") carefully before using any games, applications, or services (collectively, the "Services") provided by Funiza Games ("we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all the terms and conditions of this agreement, you may not access the Services.

1. Acceptance of Terms

By using our Services, you confirm that you are at least 16 years of age or that you are accessing the Services under the supervision of a parent or legal guardian. If you are under this age, you must have your parent or guardian's permission to use the Services.

    • Upload or transmit (or attempt to upload or transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the Services.
    • Attempt to impersonate another user or person.

5. Virtual Items and In-Game Currency

  • Purchase: Within some of our Services, you may be able to purchase virtual items or in-game currency. These purchases are non-refundable and represent a limited, non-transferable, revocable license to use the virtual items or currency within the Services.
  • No Real-World Value: Virtual items and in-game currency have no real-world value and cannot be exchanged for real money or goods from us or any third party.
  • Revocation: We reserve the right to modify or revoke your virtual items or in-game currency at any time without notice or liability.

6. User Content

  • Your Responsibilities: You are solely responsible for any content you create, transmit, or display while using our Services ("User Content"). You warrant that you have all necessary rights to your User Content and that it does not infringe on any third-party rights or violate any applicable laws.
  • License to Funiza Games: By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Services and our business, including without limitation for promoting and redistributing part or all of the Services (and derivative works thereof) in any media formats and through any media channels.
  • Monitoring: We are not responsible for User Content, but we reserve the right to monitor, review, remove, or edit User Content at our sole discretion without notice or liability.

7. Intellectual Property

  • Our Rights: All rights, title, and interest in and to the Services (excluding User Content), including all intellectual property rights, are and will remain the exclusive property of Funiza Games and its licensors.
  • Trademarks: Our names, logos, and any other product or service names, logos, or slogans that may appear on the Services are trademarks of Funiza Games and may not be copied, imitated, or used, in whole or in part, without our prior written permission.

8. Third-Party Links and Services

Our Services may contain links to third-party websites or services that are not owned or controlled by Funiza Games. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Funiza Games shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

9. Termination

We may terminate or suspend your access to all or part of the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

10. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. Funiza Games makes no warranties, express or implied, regarding the Services, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the Services will be uninterrupted, secure, or error-free.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Funiza Games, its affiliates, directors, employees, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Turkiye and Istanbul Anadolu Courts without regard to its conflict of law provisions.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Funiza Games regarding our Services.
